I. General Provisions
The data controller, as defined in Article 4(7) of the European Parliament and Council Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "GDPR"), is Shop 5% s.r.o. (hereinafter referred to as the "Controller").

Personal data refers to all information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
The Controller has not appointed a Data Protection Officer.
II. Sources and Categories of Processed Personal Data
The Controller processes personal data that you have provided or personal data that the Controller has obtained based on the fulfillment of your order.
The Controller processes your identification and contact details and data necessary for the performance of the contract.
III. Legal Basis and Purpose of Processing Personal Data
The legal basis for processing personal data is:
- The performance of a contract between you and the Controller pursuant to Article 6(1)(b) GDPR,
- The legitimate interest of the Controller in providing direct marketing (particularly for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
- Your consent to processing for the purposes of providing direct marketing (particularly for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with § 7(2) of Act No. 480/2004 Coll., on certain information society services, in cases where no goods or services have been ordered.
The purposes of processing personal data are:
- Processing your order and exercising the rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data required for the successful processing of the order (name and address, contact) is requested. Providing personal data is a necessary requirement for entering into and fulfilling the contract; without providing personal data, the contract cannot be concluded or fulfilled by the Controller,
- Sending commercial communications and conducting other marketing activities.
The Controller engages in automatic individual decision-making within the meaning of Article 22 GDPR. You have provided your explicit consent to such processing.
IV. Data Retention Period
The Controller retains personal data:
- For the period necessary to perform the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims from these contractual relationships (up to 10 years after the termination of the contractual relationship).
- For the period until consent to the processing of personal data for marketing purposes is revoked, up to a maximum of 3 years, if the personal data is processed based on consent.
After the retention period expires, the Controller will delete the personal data.
V. Recipients of Personal Data (Controller’s Subprocessors)
Recipients of personal data are individuals:
- Involved in the delivery of goods/services/payment processing based on the contract,
- Providing services for operating the e-shop and other services related to the operation of the e-shop,
- Providing marketing services.
The Controller intends to transfer personal data to a third country (a country outside the EU) or an international organization. Recipients of personal data in third countries are providers of mailing services.
VI. Your Rights
Under the conditions set forth in the GDPR, you have:
- The right to access your personal data pursuant to Article 15 GDPR,
- The right to rectification of personal data pursuant to Article 16 GDPR, and possibly the right to restriction of processing pursuant to Article 18 GDPR,
- The right to erasure of personal data pursuant to Article 17 GDPR,
- The right to object to processing pursuant to Article 21 GDPR, and
- The right to data portability pursuant to Article 20 GDPR.
You have the right to withdraw your consent to processing in writing or electronically to the Controller's address or email provided in Article III of these terms.
Additionally, you have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.
VII. Conditions for Securing Personal Data
The Controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
The Controller has implemented technical measures to secure data storage systems and personal data stored in paper form.
The Controller declares that only authorized persons have access to personal data.
VIII. Final Provisions
By submitting an order through the online order form, you confirm that you have read and fully accept the privacy policy.

The Controller is entitled to change these terms. The new version of the privacy policy will be published on its website and simultaneously sent to your email address provided to the Controller.
